VCAT Proceedings
You may be aware a Tyabb resident has lodged an application with VCAT designed to require the Quarry owners (Bayport Industries) to prove that they have non-conforming use rights to operate an open cut quarry in green wedge land. In response Bayport's lawyers lodged a counter application for the proceedings to be summarily dismissed, this has now withdrawn.
An administration mention date has been set for February 2018 and it is likely the matter will proceed to a full hearing later this year.
We believe the onus will fall on Bayport to prove to the tribunal that they have non-conforming use rights.
